Part II – Who pays the lawyer’s fees in a contract for the sale of immovable property?

As we have already discussed in Part I of this blog: there is always a lawyer’s fee for drawing up a sales contract – no question about it. But it makes a difference how much it is and, more importantly, what you get in return.

Cheaper = better?

This raises one of the most important questions:
Price should not be the primary deciding factor in sales contracts.

When buying a property, many questions arise – one of the most common being:

“Who pays the lawyer for the sales contract?”

Many people will immediately say “The buyer!
This is indeed a common answer, and not without reason: the lawyer’s assistance is mandatory, but not free.

Under Hungarian law, the parties agree on the costs, but in practice the buyer typically bears the costs, since he or she chooses a lawyer and it is in his or her interest to carry out the acquisition.

🏡 Why does it matter who and how the contract is drawn up?

House prices are now sky high. Contracts are getting more and more complicated:

  • a plethora of legislation,
  • bank requirements (especially for loans),
  • legal risks on all sides.

A sales contract is not a “copy-paste” document. ( Copy-paste is an English term that literally means “copy and paste”.)
